A FCT High Court on Tuesday
sentenced to death a 25-year-old ex-police Corporal, Smart Udeme, for
killing his colleague, Sergeant Yunusa Isah of Mopol 7 Squadron, Sokoto.
The trial judge, Justice Mohammed Talba, in his judgment, held that
the prosecution had established a case of culpable homicide against the
convict.
Talba said: “It is the law that the burden of proof rest on the prosecution to establish its case beyond reasonable doubt.
“The prosecution can discharge its burden on three grounds, either
by direct evidence of eyewitness, confessional statements and
circumstantial evidence.
“It is crystal clear that the law does not provide for any exercise of discretion in passing sentence.
“And even where the trend of events on the importance judiciary
reveals that the discretionary powers of a judge is no more exercisable
within the ambit of the law.
“I am therefore constrained to impose the sentence as provided by the law.
“Consequently, I, therefore, sentence the convict to death by hanging.”
Talba also said the convict had a right to appeal against the judgment of the court.
The News Agency of Nigeria reports that the Udeme was arraigned by
the police on November 10, 2008 on a charge of culpable homicide but
pleaded not guilty.
The prosecution submitted that the offence committed contravened Section 221 of the Penal Code.

Bengaluru: A 35-year-old woman was allegedly raped by two security guards at the famous Cubbon Park here last night, police said today.
Police said they have arrested both the security guards in connection with the incident.
The woman hailing from Tumkuru had come to the city to take membership in a tennis club functioning at the sprawling Cubbon Park when the incident occurred, they said.
Deputy Commissioner of Police (Central) Sandeep Patil said "The incident came to light when an Assistant Sub-Inspector who was on rounds noticed the woman sitting near Siddalingaiah Circle around 2.30 AM and questioned her." He said, "Immediately she was brought to the Cubbon Park Police Station and a detailed statement taken from her."
The woman had come to the club late afternoon. Though some workers told her there was none in the club and asked her to come today, she decided to stay back near by. At about 9:30 PM noticing her alone in the park two security guards approached her, the DCP said.
When she asked them to help her make her exit from the park as she did not know the way, the guards under the pretext of helping her had taken her to a secluded place and allegedly raped her.
Patil said, "A case has been registered last night. Guards have been detained, detailed investigation is going on and medical examination of victim and two accused is also being done." He said a case has been booked under Indian Penal Code section 376 (punishment for rape).

Jaymala Kumbhare (left), who has been arrested, and her daughter, Durga, whom the police are trying to locate
All members of the family are highly qualified and played different roles when the crime unfolded. The arrested woman, Jaymala Kumbhare’s husband Satish works in a nationalised bank, son Tapan works in the Merchant Navy and daughter Durga is a dentist.
According to Charkop police station sources, while Jaymala selected the target, most of the time, her husband Satish would impersonate a MHADA officer and issue allotment letters to dupe people. Their son Tapan handled monetary transactions and daughter Durga played a mediator’s role.
In this case, which played out in January 2012, 34-year-old Clera Saji George — who had been searching for a flat in Charkop for many years — got in touch with this family through a mutual friend, Anita Raja. Anita informed Clera about the family and told her that they could help her to find a cheap flat as per her requirement.
Victim Clera contacted Jaymala and told her to manage a cheap flat in Charkop. Jaymala showed her a flat (no 1701) in MHADA Charkop, new MHADA Tower building 55E, on the 17th floor. The victim became ready to buy this flat, but due to shortage of money, she told Jaymala that she could not pay Rs 27 lakh at one time.
From 2013 to 2014, Clera paid Jaymala Rs 15 lakh in cash and cheque. The accused family gave Clera an allotment letter for the flat that was promised. In 2014, Clera was shocked after she found that some other family was residing in the flat for which she had already paid Rs 15 lakh. Later, when she tried to approach Jaymala, she had disappeared.

The victim then filed a complaint with the Charkop police against all members of the Kumbhare family. According to Assistant Police Inspector Pradip Raorane of the Charkop police, Jaymala was arrested from Kandivli. All the family members were involved in the con job.
A case has also been registered against the family in Amboli police station and by the Economic Offences Wing, for similar crimes. On November 7, the Charkop police registered a case against all the family members under Sections 420, 467, 468, 471, 406, 120 (B) and 34 of the IPC. Jaymala has been arrested and is in judicial custody while the police are on the lookout for the other family members, Raorane added. - See more at: http://www.mid-day.com/articles/mumbai-con-family-promises-mhada-flat-cheats-housewife-of-lakhs/16675154#sthash.GeSjQ0jg.dpuf

On November 7, the Charkop police registered a case against all the family members under Sections 420, 467, 468, 471, 406, 120 (B) and 34 of the IPC.
